Resale or Third Party Supply
All goods purchased are for own use and are offered also for re-sale. We hold the right to refuse to supply any person or company.
Framed Paintings
If you require a frame for your portrait you will need to allow an additional 2 business days for delivery.
Frames published on the website are mere sample photos, delivered frames might differ slightly depending on actual frame stock.
Modifications
In the event you require modifications to your painting, an additional 2-4 business days will be added to the normal delivery timeframe.
The customer is allowed to request up to 5 modifications after receiving the preview, however, after the 5th modification, we consider the order as cancelled.
Payment Methods
Any and all orders you place uses a secure encryption, the Internet standard for secure transactions. Our secure payment service provider is PayPal. For detailed information, you can review paypal.com. Fine Art Portrait Co. will provide you with the safest and most secure shopping experience available. Since technology and our offers change, we reserve the right to change, modify, add, or remove portions of our website at any time without prior notice.
Please note that after receiving a payment request for your approved portrait the payment will need to be made within seven days. Failure to do so will result in a storage fee of £1.00 per day.
Cancellation of Order & Refund Policy:
After the painting process has begun, we will not accept any new photos from the customer. After you have received and approved the initial preview, it is not possible to cancel your order at this stage. No refunds will be offered if the received portrait is different from the agreed preview this is due to camera quality and screen resolution. As per the Law of the United States of America and the European Union, producers of custom-made products are not required to provide a return / refund policy. The sale is final. Various card issuing banks may charge you an “International Service Fee” based on your location, regardless of whether or not a currency conversion is involved. It is important to note that even if Fine Art Portrait Co. made the charge in the currency of your country and card account, your issuing bank may still charge you this fee. This additional charge is not made by Fine Art Portraits Co. but is made entirely at the discretion of your card issuing bank. We can therefore not refund such charges. Please, contact your bank in such cases and consider filing a complaint.

We will not sell or pass the information we collect on to any third parties. Only after making an agreement with customers will we use it to communicate with them by email when we have information we think may be of relevance. In this section we refer to “personally identifiable information”, which is information that enables us to identify, such as email address’, names, and postal address’. Like many e-commerce web sites, Fine Art Portrait Co. works with PayPal, which is a 100% secure online payment service. The website uses following cookies: We are using Google Analytics. This cookie allows us to see information on user website activities, including, but not limited to page views, source and time spend on website. The information is depersonalised and is displayed as numbers, ensuring it cannot be tracked back to individuals. Using Google Analytics we can identify more popular content, and allows us to always improve our website. Using Google Adwords code we are able to see which pages helped to contact from submission. This allows us to make better use of our paid search budget. We use re-marketing codes to log when users view specific pages, allowing us to provide targeted advertising in the future. Customers ordering on this website are agreeing to receive our newsletters and promotional emails in the future.
General Terms
Fine Art Portrait Co. will strive to ensure that the website and other services are available at all times, but reserves the right to modify, suspend, or discontinue all or any part at any time with or without notice. Unless specifically exempted, any new features, services, or software applications introduced shall be subject to these Terms and Conditions. We reserve the right to make changes to these Terms and Conditions at any time. Any change shall be effective immediately. Each time you use the service you are deemed to have accepted any such change. We accept no liability to the fullest extent allowed by law for the accuracy of the contents of the website which may contain technical inaccuracies or typographical errors. This provision, however, does not affect your statutory rights. In no circumstances will Fine Art Portrait Co. be liable for any loss or damages, whether direct, or consequential arising out of: (a) your use of Fine Art Portraits Co. site, services, or your inability to do so; (b) your reliance on any content and/or: (c) goods and services in any way associated with the site and services. (d) Taxes and duties which maybe be due in your state or country. We will not be liable to you for any loss or damage caused by us, in circumstances where: (a) there is no breach of duty of care owed to you by us or by any of our directors, our employees or agents; (b) such loss or damage is not a reasonably foreseeable result of any such breach; (c) any increase in loss or damage results from breach by you of any of these Terms and Conditions; (d) such loss or damage relates to any business or non-consumer loss or damage including, without limitation lost data, lost profits, and business interruptions. As also mentioned in the FAQ page, our portrait artists directly send the artwork to our customers. Our portraits are painted in P.R.C. and shipped from this location. Fine Art Portraits Co. is a limited liability company, and all possible liabilities are limited to the company’s stock capital and the owners and directors of the company are held free of personal liability. We do not accept any responsibility for items held or delayed by Customs. Due to our worldwide client base, we are unable to keep track with any local import regulation. All paintings are made to order and are custom made. Fine Art Portrait Co. cannot accept the return of approved custom made paintings. When placing your order, a 25% down payment will be requested. After the customer has accepted the preview photo of the painting, the balance will be charged. It is agreed, that balance payments have to be initiated within 24 hours after the customer accepted the completed painting. The painting will only be shipped after the balance and shipping fees are received. We reserve the right to alter prices of paintings without prior notice, however orders in progress will not be affected.
Copyright
All images on our site are either licensed or in the public domain because their copyright has expired. This applies to the United States, Canada, the European Union and those countries with a copyright term of life of the author plus 50 -70 years. In the event you find any content on this website that you believe to be under copyright protection, please contact us immediately and it will be removed. In addition, faithful reproductions of two-dimensional original works cannot attract copyright in the U.S. according to the rule in Bridgeman Art Library vs. Corel Corp. The customer accepts by ordering from the Fine Art Portrait Co. that we have the right to publish the completed artwork on our website or Facebook. However, if notified by the customer in advance, we will ensure that the artworks are not published by us.
For all portrait paintings as well as paintings on request customers are both responsible and liable for the images they upload or send per email. Fine Art Portrait Co. represents a derivative product based on customers’ photographs, provided by the customer or stock images of public domain masterpieces. Reproductions of masterpieces will differ in size from the originals, and this product type will not be signed with the name of the original artist.
Our paintings are not photographic reproductions and might differ from the original in size, signature, brushstrokes and other details. Responsibility to ensure that the image is in the public domain, use is within fair use provisions or that any copyright permissions required have been granted remains with the customer.
